Antitrust in the Biden Administration

Will the new executive order change America?

August 31, 2021

In July, President Biden issued an expansive executive order intended to promote competition in the American economy (“Executive Order”). The Executive Order requires 72 initiatives by more than a dozen federal agencies, in addition to targeting specific industries perceived as areas of particular concern. The technology sector is a specific focus - the order challenges the use of monopoly power by dominant industry players “to exclude market entrants, to extract monopoly profits, and to gather intimate personal information that they can exploit for their own advantage.”

The Executive Order is just one of many recent steps the Biden Administration has taken toward escalating antitrust enforcement in the U.S.

In this publication, Norton Rose Fulbright’s Antitrust & Competition team discusses recent enforcement trends and the Executive Order and provides helpful guidance to companies operating in the technology & innovation sector.
